Terms and conditions
Shipment conditions
It is the client’s responsibility to ensure that shipments are prepared according to international airfreight standards and do not contain and dangerous, hazardous, or prohibited items as defined by the IATA, IACO and any other regulatory organization. Priority Freight reserves the right to refuse to transport items that it believes cannot be transported in a safe or legal manner and can inspect shipments at any time without prior consent of the Client.
The Client must prepare the shipment to airfreight specifications in secure premises using trusted employees. The client is obligated to provide and provide complete, accurate shipment documentation including invoices, export declaration and any other applicable permits/licenses.
Additional charges
The client is liable for any additional charges that are incurred in the process of shipment including, but not limited to, demurrage, additional packing to airfreight standards, customs charges, and expenses accrued due to Acts of God and Force Majeure.
Liability
Priority Freight is not liable for any loss or damage unless the client proves that the loss/damage was caused by Priority Freight or its agents.
In the event that Priority Freight is liable for loss/damage, the liability will never exceed the invoice value of the goods and is further restricted by the Warsaw Convention of 1929 and Hague Protocol of 1955, to 17 SDR per Kilogram of lost/damaged cargo. If Priority Freight is liable and insurance practices determine that the shipment can be repaired instead of replaced, Priority Freight is liable for repair.
Additional insurance
Priority Freight can arrange for insurance to cover the actual cash value of the shipment at the specific request of, and additional charge to, the Client.
Acts of God and Force Majeure
Priority Freight is not liable for loss or damage caused by “Acts of God” (including, but not limited to earthquake, storm, cyclone, flood, fog, fire) or “Force Majeure” including, but not limited to (war, plane crash, embargo, civil unrest, shipment defect, electrical/magnetic damage or act/omission of any person not employed by Priority Freight).
Legal Jurisdiction
All disputes connected with these terms and conditions will be resolved according to the laws of the Republic of Cyprus.
